These terms and conditions govern the relationship between Net IT EOOD (hereinafter "WDesign", "the Provider", "we") and the persons using the website and the services offered (hereinafter "the User", "the Client", "you").
Using the website and ordering a service means you have read and fully accept these terms. If you do not agree with them, please do not use our services.
These terms are drawn up in accordance with Regulation (EU) 2016/679 (GDPR), applicable consumer protection legislation and the law of the European Union.
WDesign provides the following services:
The service is provided remotely, by means of distance communication.
The contract is deemed concluded at the moment the User expressly accepts the completed design and makes payment. No payment obligation arises before that moment.
Generating a preliminary design is free of charge and places the User under no obligation.
Prices are fixed and published on the "Pricing" page:
All prices are excluding VAT. VAT is applied in accordance with applicable legislation. For clients VAT-registered in another EU Member State, the reverse charge mechanism applies under Article 196 of Directive 2006/112/EC.
Payment is made by bank transfer or through the payment methods shown on the website. Work begins once payment is confirmed.
Money-back guarantee: if the final site with all its sub-pages does not satisfy you, you may request a refund of the amount paid within 5 days of receiving the completed site. The full amount is refunded, no questions asked.
Condition: the guarantee applies only if the site has been viewed online only and the User has not downloaded the files via the "Download" button or by any other means. Downloading the files constitutes final acceptance of the work and results in the loss of the right to a refund.
Under applicable consumer protection law, a consumer has the right to withdraw from a distance contract within 14 days without giving a reason.
Exception: the right of withdrawal does not apply to service contracts that have been fully performed where performance began with the consumer's prior express consent and acknowledgement that the right of withdrawal would be lost once the contract was fully performed, nor to the supply of digital content not delivered on a tangible medium.
By ordering a website, you give your express consent for performance to begin immediately and confirm you have been informed of the above. Notwithstanding this, WDesign voluntarily offers the 5-day money-back guarantee described above, subject to the stated condition.
Downloading as acceptance: clicking the "Download" button or obtaining the site files by any means constitutes express confirmation by the User that they accept the work as fully conforming to what was agreed. Through this action the User receives the digital content in full and the right of withdrawal, and therefore the right to a refund, is extinguished.
Until the files are downloaded, the site is available for review online at an address provided by WDesign, allowing the User to become fully acquainted with the work before finally accepting it.
Any withdrawal or refund request should be sent to contact@wdesign.bg. Refunds are made within 14 days of receiving the request, using the same payment method unless otherwise agreed.
Until payment is made in full, the generated design and the completed site remain the property of WDesign.
Following full payment, the User acquires a non-exclusive, perpetual and territorially unrestricted right to use the completed site for their business, including the right to modify it, transfer it to another host and use it commercially.
The site files are made available for download after payment. Downloading them constitutes delivery and final acceptance of the work.
WDesign retains its rights in the templates, libraries, generators and technical solutions used which are not specific to a particular User.
WDesign reserves the right to include completed designs in its public portfolio with the client's name, unless the User expressly objects in writing to contact@wdesign.bg.
The User warrants that they hold the necessary rights to all materials (text, images, logos, trademarks) they provide for inclusion in the site and accepts full responsibility for any infringement of third-party rights.
The User undertakes to:
WDesign shall not be liable for any direct, indirect, incidental, special or consequential damages arising from or connected with the use of, or inability to use, the services provided and the completed site.
In particular, WDesign is not liable for:
Maximum liability: should liability nevertheless be established, it is limited to the amount actually paid by the User for the service in question and shall not exceed it.
The limitations in this section apply to the fullest extent permitted by applicable law. Nothing in these terms excludes or limits WDesign's liability for wilful misconduct, gross negligence or for damages where liability cannot lawfully be excluded.
The User is informed and accepts that part of the content and design is generated by artificial intelligence systems. Although every result is reviewed and validated by the WDesign team, the User understands that:
WDesign processes personal data in accordance with Regulation (EU) 2016/679 (GDPR). Detailed information on purposes, legal bases, retention periods and data subject rights is set out in the Privacy policy.
Where WDesign processes personal data on behalf of the User (for example data of their customers stored in the completed site), the parties act respectively as processor and controller. Where necessary, a separate data processing agreement is concluded under Article 28 GDPR.
WDesign will remedy free of charge any technical defects in the completed site identified within 30 days of handover, insofar as they result from WDesign's performance.
The warranty does not cover: changes made by the User or third parties; issues arising from the hosting environment; requested new functionality; problems caused by external services and integrations.
Maintenance beyond this period is agreed separately.
WDesign may refuse or discontinue a service in the event of: breach of these terms; provision of false information; use of the service for unlawful purposes; failure to pay on time.
The User may stop using the service at any time before the contract is concluded, without obligation.
Neither party is liable for non-performance due to force majeure — natural disasters, war, epidemics, acts of public authorities, loss of internet connectivity, failure of third-party services or other circumstances beyond their reasonable control.
WDesign may amend these terms by publishing the current version on this page with the date of last update. Contracts already concluded remain governed by the version in force at the time of conclusion.
The parties will seek to resolve disputes amicably. Failing that, the dispute is referred to the competent court, unless a mandatory rule provides otherwise.
The applicable law is Bulgarian law and the law of the European Union. For consumers resident in another country, mandatory local consumer protection rules continue to apply.

If any provision of these terms is held invalid, this does not affect the validity of the remaining provisions.
Matters not covered here are governed by the applicable law.
These terms are drawn up in English. In the event of translation into another language, the English version prevails.
